These Terms of Service ("Terms") apply to your use of this website and your purchases from it. The site is operated by Lento Foods, LLC, a Colorado limited liability company doing business as "lento" ("lento," "we," "us," or "our"). By using this site or placing an order, you agree to these Terms, our Privacy Policy, our Shipping Policy, our Refund Policy, and, if you subscribe, our Cancellation Policy, which are part of these Terms. If you don't agree, please don't use the site.

1. Eligibility

You must be at least 18 years old (or the age of majority where you live) to place an order. Anyone younger may use the site only with a parent or guardian's involvement.

2. Our online store

Our store is hosted by Shopify Inc., which provides the e-commerce platform we use to sell products to you. Payments are processed by our third-party payment providers. By using the store, you also agree to any terms those providers require when you check out.

3. Orders

When you place an order, you're making an offer to buy. We accept it when we ship the order. We may refuse or cancel any order, or limit quantities, for example if a product is out of stock, a price or description is wrong, we suspect fraud, or the shipping address is outside the areas we serve. If we cancel an order after you've paid, we'll give you a full refund.

4. Prices and payment

All prices are in U.S. dollars. Prices, products, and promotions may change at any time without notice. We try hard to keep everything accurate, but mistakes can happen. If we find a pricing error on something you ordered, we'll contact you before we ship. You can then confirm the order at the correct price or cancel it for a full refund. Applicable sales tax and shipping charges are calculated at checkout.

5. Product information and allergens

We try to display our products, ingredients, and nutrition information accurately, but photos are for illustration and colors or appearance may vary. The ingredient list and allergen information printed on the package you receive is the most accurate source. Please read it before eating, especially if you have a food allergy or sensitivity. Nothing on this site is medical or nutritional advice. If you have health concerns, talk to a qualified healthcare professional.

Our products are meant to be eaten by the best-by date and stored as directed on the package. We aren't responsible for problems caused by improper storage after delivery.

6. Shipping, risk of loss, and refunds

We ship only to the destinations listed in our Shipping Policy. Title and risk of loss pass to you when the carrier delivers your order. That doesn't limit our commitment to replace or refund lost or damaged orders as described in our Refund Policy. Because our products are food, we don't accept returns except as described in that policy.

7. Promotions and discount codes

Discount codes and promotions are subject to any terms stated with them. Unless we say otherwise, they can't be combined, have no cash value, and may be withdrawn at any time.

8. Reviews and content you send us

If you send us reviews, photos, comments, or ideas (for example, by email, social media tags, or a review on our site), you give us a non-exclusive, royalty-free, perpetual license to use, reproduce, and display that content in connection with our business. You must own the content or have permission to share it, and it must not be unlawful, misleading, or offensive. We may, but are not obligated to, review, edit, or remove any content.

9. Intellectual property

The lento name, logo, packaging, photos, recipes, text, and other content on this site belong to Lento Foods, LLC or its licensors. They are protected by intellectual property laws. You may not copy, reproduce, or use them for commercial purposes without our written permission.

10. Acceptable use

You agree not to misuse the site. This includes: breaking any law; placing fraudulent orders; buying products for resale without our written consent; interfering with the site's security or operation; scraping or harvesting data; or uploading viruses or malicious code.

11. Third-party links

The site may link to third-party websites (for example, Instagram). We don't control and aren't responsible for their content or practices.

12. Disclaimer of warranties

Except as stated in these Terms and our Refund Policy, and to the fullest extent permitted by law, the site and all products are provided "as is" and "as available." We make no other warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't guarantee that the site will be uninterrupted or error-free.

13. Limitation of liability

To the fullest extent permitted by law, Lento Foods, LLC and its owners, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the site or our products. Our total liability for any claim relating to an order will not exceed the amount you paid for that order. Some jurisdictions don't allow these limits, so they may not apply to you. Nothing in these Terms limits liability that can't be limited under applicable law.

14. Indemnification

You agree to defend, indemnify, and hold harmless Lento Foods, LLC and its owners and employees from claims, losses, and expenses (including reasonable attorneys' fees) arising from your breach of these Terms or your misuse of the site.

15. Governing law and disputes

These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law rules. Any dispute arising from these Terms or your purchases will be resolved exclusively in the state or federal courts located in Colorado, and you consent to their jurisdiction. Before filing any claim, please contact us first at hello@lentofoods.com. Most concerns can be resolved quickly and informally.

16. Changes to these Terms

We may update these Terms from time to time. We'll post the new version here and update the "Last updated" date. Changes apply to orders placed after they're posted.

17. General

If any part of these Terms is found unenforceable, the rest remains in effect. If we don't enforce a provision, that doesn't waive our right to enforce it later. These Terms, together with the policies referenced above, are the entire agreement between you and us about the site and your purchases.
